Welcome to The Day Trading Dojo, a DBA of Catco Media Inc. ("Company," "we," "our," or "us"). By accessing this website, purchasing our products or services, joining our community, booking a call, or participating in our programs (collectively, the "Services"), you ("you" or "User") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Services.
1. Eligibility
You represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. The Services are not directed to minors.
2. Educational Purposes Only
The Day Trading Dojo provides educational content, mentorship, coaching, and market commentary for informational and educational purposes only. Nothing contained on our website, in our videos, Discord community, coaching calls, courses, downloadable materials, or any other channel constitutes financial, investment, legal, tax, or accounting advice.
Catco Media Inc. and The Day Trading Dojo are not registered as an investment adviser, broker-dealer, futures commission merchant, commodity trading advisor, or in any other regulated capacity with the SEC, FINRA, CFTC, NFA, or any other regulatory body. Nothing we provide should be construed as a recommendation, solicitation, or offer to buy or sell any security, future, contract, or financial instrument.
You should consult a licensed professional before making any financial decisions.
3. Risk Disclosure
You acknowledge that trading futures, equities, options, forex, cryptocurrency, and other financial instruments involves substantial risk of loss and is not suitable for every investor. You may lose some or all of your invested capital. Past performance is not indicative of future results.
4. Hypothetical Performance Disclaimer (CFTC Rule 4.41)
Any examples, demonstrations, simulations, backtests, or "what if" trades shown in our content are hypothetical or simulated and have inherent limitations. Hypothetical performance results do not represent actual trading and may differ materially from results achieved in any real account. Factors such as liquidity, slippage, emotional discipline, and market conditions cannot be fully accounted for in simulated or example trades.
5. No Guarantee of Results
We do not guarantee any specific financial outcome, funded-account approval, trading consistency, profitability, or income level. Any testimonials, case studies, examples, or results shared by students, mentors, or instructors are not typical and are provided for illustrative purposes only. Individual results vary based on effort, discipline, capital, market conditions, and many factors outside our control.
6. User Responsibility
You acknowledge that you are solely responsible for your own trading decisions, actions, use of capital, risk management, and financial outcomes. You agree that Catco Media Inc., The Day Trading Dojo, and our officers, directors, employees, contractors, and affiliates are not liable for any losses, damages, or financial harm resulting from your use of our educational materials or Services.
7. Payments and Purchases
All purchases are subject to the pricing, payment schedule, and terms presented at the time of sale and the separate Service Agreement signed at enrollment. By purchasing a program or service, you authorize Catco Media Inc. to process payment through approved third-party payment processors and to charge the payment method on file for any installments outlined in your Service Agreement.
8. Refund and Chargeback Policy
Due to the digital, educational, and time-sensitive nature of our products and services, all sales are final and non-refundable unless otherwise stated in writing in your Service Agreement. Access to digital materials, coaching calls, Discord communities, downloadable content, recordings, or any other educational resource constitutes delivery of the purchased service.
By purchasing, you expressly waive any right to initiate a chargeback, payment dispute, or refund claim with your bank, card issuer, or payment processor for any reason other than unauthorized use of your payment method. Any chargeback, dispute, or fraudulent refund claim filed in violation of this section will result in (a) immediate and permanent termination of access to all programs and Services, (b) liability for the full purchase price plus any chargeback fees, processing costs, and reasonable attorneys' fees incurred by Catco Media Inc. in defending the dispute, and (c) referral to collections.
9. Community Guidelines
Users participating in Discord groups, coaching calls, live events, or any community space agree to behave respectfully and professionally. We reserve the right to remove, suspend, or permanently terminate access for harassment, abusive conduct, disruptive behavior, spam, unauthorized solicitation, sharing of proprietary materials, or violation of these Terms — without refund.
10. Intellectual Property and Anti-Piracy
All content provided by The Day Trading Dojo and Catco Media Inc., including but not limited to videos, recordings, branding, logos, text, graphics, training materials, frameworks, systems, trading methods, course content, slides, and templates (collectively, "Content"), is the exclusive property of Catco Media Inc. and is protected by U.S. and international copyright, trademark, and intellectual property laws.
You may not reproduce, redistribute, share, sell, copy, screen-record, screenshot for distribution, repackage, or publicly disclose any Content without our prior express written permission.
Any unauthorized sharing, leaking, or redistribution of Content constitutes a material breach of these Terms. You agree that quantifying actual damages from such conduct would be impractical, and therefore you agree to pay liquidated damages of $5,000 USD per instance of unauthorized distribution, in addition to any other legal or equitable remedies available, including injunctive relief and reasonable attorneys' fees.
11. Third-Party Services
Our website and Services may reference, link to, or integrate with third-party tools, brokers, prop firms, software, payment processors, or platforms. We are not responsible for the availability, accuracy, policies, content, security, or performance of any third-party service. Your interactions with any third party are solely between you and that party.
12. Disclaimer of Warranties
All Services, Content, and materials are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, or non-infringement. We make no representations that the Services will be uninterrupted, error-free, or that any defects will be corrected.
13. Limitation of Liability
To the fullest extent permitted by law, Catco Media Inc., The Day Trading Dojo, and our officers, directors, employees, contractors, and affiliates shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to lost profits, lost trading capital, lost data, or business interruption, arising from your use of our Services or participation in our programs, even if we have been advised of the possibility of such damages.
Our total aggregate liability arising out of or related to these Terms or the Services shall not exceed the lesser of (a) the total amount you paid us in the twelve (12) months preceding the claim, or (b) $5,000 USD.
14. Indemnification
You agree to indemnify, defend, and hold harmless Catco Media Inc., The Day Trading Dojo, and our officers, directors, employees, contractors, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, your violation of any law or third-party right, or your trading activity.
15. Dispute Resolution; Arbitration; Class-Action Waiver
Please read this section carefully — it affects your legal rights.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved exclusively by final and binding arbitration administered by JAMS in Los Angeles, California, under its Streamlined Arbitration Rules. The arbitrator's decision shall be final and enforceable in any court of competent jurisdiction.
You and Catco Media Inc. each waive the right to a trial by jury and the right to participate in any class action, class arbitration, or representative proceeding. All claims must be brought in your individual capacity only.
The only exceptions are: (a) either party may seek injunctive or equitable relief in court to protect intellectual property rights, and (b) either party may bring a claim in small-claims court if it qualifies.
16. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Subject to Section 15, any court proceedings shall be brought exclusively in the state or federal courts located in Los Angeles County, California.
17. Modifications to These Terms
We may update these Terms from time to time. The "Last Updated" date at the top reflects the most recent revision. For material changes, we will provide reasonable notice via email to registered users or a prominent notice on the website at least thirty (30) days before the changes take effect. Continued use of the Services after the effective date of an update constitutes your acceptance of the revised Terms.
18. Termination
We reserve the right to suspend or terminate your access to the Services at any time, with or without cause and with or without notice, including for any violation of these Terms. Upon termination, your right to access the Services ceases immediately. Sections 6, 8, 10, 12, 13, 14, 15, and 16 survive termination.
19. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be replaced with an enforceable provision that most closely reflects the original intent.
20. Entire Agreement
These Terms, together with any Service Agreement, Privacy Policy, and any other policies referenced on our website, constitute the entire agreement between you and Catco Media Inc. regarding the Services and supersede all prior agreements or communications.
